Building permits, heritage controls and defect disputes in Ballarat
Building work in Ballarat needs a building permit from a registered building surveyor, and many older streets also sit under a Heritage Overlay that can require a planning permit for external changes. City of Ballarat is part way through a review of its heritage places. When a builder will not fix a defect, the path runs through the Building and Plumbing Commission before VCAT.
Building permit and occupancy permit
A registered building surveyor issues the building permit, carries out the mandatory inspections and issues the occupancy permit at completion. Their role is compliance, not an itemised list of workmanship items for you.
Heritage in older streets
City of Ballarat is reviewing the places and precincts in its Heritage Overlay, with a first stage in 2025 and further phases from 2026. If you are buying in an older street, check the overlay before planning an extension, a new roof or replacement windows.
Bushfire Management Overlay
Some land in the municipality is covered by the Bushfire Management Overlay. Homes built to a BAL rating rely on sealed gaps and specified materials, which is exactly what we check on bushfire rated houses.
When the builder will not act
Put the defect to the builder in writing first. If it is not resolved, the Building and Plumbing Commission's dispute resolution service (formerly DBDRV) is the next step, then VCAT's Building and Property List.
Which report for which stage
Our defect investigation report is aimed at you and your builder, to get items fixed. If the dispute reaches VCAT, you need an expert witness report written to VCAT's expert evidence practice note instead.
